September 24th Planning Board meeting minutes
Members Present: Alan Solomon, Steve Rose, Larry Klein, Maggie Leonard and Bridget Krans
Public Present: Peter Valianos representing Mr. and Mrs. Stencil who were also present and David Hellman representing Judy Bach
To order: 7:00 PM
- Mr. and Mrs. Stencil are looking for a variance as a result of their garage being too close to the side setback. They expressed that they cannot buy a piece of the neighbors land because a survey suggested it would leave the lot non- conforming. In October of 2003 some of the building permit received signatures but not on everything. The garage is 6feet 8 inches into the setback. It sits behind a row of fully matured trees. The original pour was never inspected. An inspection was requested and never received. Mr. Valianos suggested that there is minimal intrusion. The next closest house is more than 250 feet away. It has been 6 years since the garage was constructed and the Stencils never received any indication until now that there was a problem.
- The board agreed to make a favorable recommendation. Maggie will write the recommendation and deliver it to the ZBA.
- David Hellman was present to represent Judy Bach regarding the subdivision project on Mt. Hunger road. Mr. Hellman expressed that the cost of permitting and designing was over budget and Ms. Bach is requesting that they be allowed to build the first part of the road and the common driveway to enable them to sell the first lot in order to fund the project. The board would have to release the covenant. It would be a partial release. Alan suggested getting an opinion from our engineer that worked on the project. The board wondered if putting in a partial road and driveway may have an adverse effect on water flow ect. Also the lot will still need 200 feet of frontage. Mr. Hellman is going to inform the Bach’s that they need to make the road at least 200 feet to be conforming for the lot.
- The previous meeting minutes from August 27th were approved as written.
- On October 8th Maggie will not be present.
